A clear controller–processor agreement

These terms form the data-processing part of the Training Colour agreement between the subscribing coach or coaching business (the Controller) and Life Mode Fitness (the Processor).

1. Subject and duration

Life Mode Fitness processes client information only to provide Training Colour for the duration of the coach’s trial or subscription, plus the limited return and deletion period described below.

2. Processing details

The service collects and stores client identity and contact details, assessment answers, generated preference scores and results, consent choices, coach debrief notes and review dates. Processing includes collection, organisation, storage, retrieval, email delivery, export and deletion. Data subjects are the Controller’s clients or prospective clients.

3. Documented instructions

Life Mode Fitness will process client information only on documented instructions from the Controller, including the ordinary instructions expressed through use of the product, unless UK law requires otherwise. The Controller is responsible for lawful collection, transparency, assessment suitability and responding to clients.

4. Confidentiality and security

Life Mode Fitness will limit access to people and providers who need it, require confidentiality, use reasonable technical and organisational safeguards, separate coach workspaces and maintain protected account access.

5. Subprocessors

The Controller gives general authorisation for the providers listed on the subprocessors page. Material changes will be published before they take effect where reasonably possible. Life Mode Fitness remains responsible for subprocessor obligations required by data-protection law.

6. Assistance

Taking account of the nature of the service, Life Mode Fitness will provide reasonable assistance with data-subject requests, security incidents, impact assessments and regulator enquiries. Coaches can export records and permanently delete individual client records without waiting for support.

7. Incidents

Life Mode Fitness will notify the Controller without undue delay after becoming aware of a personal-data breach affecting their Training Colour records and will provide available information needed for the Controller’s assessment and notification duties.

8. Return and deletion

On request or account closure, the Controller may export client records. Life Mode Fitness will delete remaining client information within 30 days after the service ends, unless UK law requires retention. Limited encrypted backups may remain until overwritten under normal retention cycles.

9. Audit information

Life Mode Fitness will make available information reasonably necessary to demonstrate compliance and will cooperate with proportionate audits. The Controller must protect other customers’ confidentiality and meet reasonable costs of exceptional, bespoke audits.

10. International processing

Where personal information is transferred outside the United Kingdom, Life Mode Fitness will use a lawful transfer mechanism and require appropriate safeguards from the relevant provider.
